Terms of Service

1. Acceptance

By using BrandSuite (brandsuite.io and app.brandsuite.io, the "Platform") you fully accept these Terms. The Platform is provided by DIBS SRL (Company: DIBS SRL — Registered office: Via Romagnosi 6, 50134 Florence, Italy — VAT/Tax ID: 07181170486), hereinafter "the Provider". If you do not accept these Terms you must not use the service.

2. Service description

BrandSuite is a SaaS platform helping agencies, founders and freelancers turn a brief into a structured Deliverable Pack (research, blueprint, backlog, brand kit, frontend prototype, business plan). The service uses third-party AI models. Outputs are generated probabilistically and require human review before being used in production or delivered to end clients.

3. Account and registration

  • To use BrandSuite you must register an account providing truthful and up-to-date data
  • You are responsible for the confidentiality of your access credentials
  • You must be at least 18 years old or the minimum age required in your country
  • An account is personal unless the terms shown at activation expressly provide multi-user access
  • We reserve the right to suspend or close accounts for Terms violations or fraudulent use

4. Plans and subscriptions

Before public launch, commercial availability, pricing, capacity and features may change. The applicable terms are those shown and accepted at activation or purchase:

  • Access may be free, pre-registration only, trial-based or paid according to the offer actually available
  • Included capacity, features, limits, price and duration are shown before confirmation
  • Any automatic renewal, its frequency and cancellation method are disclosed before purchase
  • Cancellation does not reverse amounts already accrued, subject to non-waivable rights or more favorable terms stated in the offer

5. Credit system

Some AI operations may use an internal usage capacity or balance. Applicable rules are shown in the interface or in the available offer terms before use:

  • Required capacity may vary by model, format and operation complexity
  • Where available, the interface shows the cost or estimate before the operation is confirmed
  • Expiry, renewal, refunds and any purchase of additional capacity are governed by the offer actually accepted
  • We do not present commercial rules or quantities not yet published in the purchase flow as final

6. Payments and billing

  • When payments are available, they are processed through Stripe according to the provider configuration and terms; BrandSuite does not ask users to enter full card details into its own application forms
  • Invoices are issued by DIBS SRL (VAT 07181170486) electronically via the Italian SDI system for Italian users
  • Prices are shown excluding VAT unless otherwise stated
  • In case of non-payment the service may be limited or suspended under the terms communicated in the offer and applicable law
  • EU consumers benefit from the 14-day right of withdrawal unless they have started using the digital service with explicit consent to waive it

7. Experimental features and AI content

Some features, including planning, calendar, review or content preparation, may be offered in preview, alpha or beta and are not guaranteed to be generally available. AI outputs are drafts that must be checked and approved manually before publication or delivery. Users remain responsible for destination-channel policies, copyright and rights relating to the assets they use.

8. Intellectual property

All content you upload (briefs, brand guidelines, assets) remains your property. You grant the Provider a limited, non-exclusive, revocable license to process it solely to deliver the service.

Outputs generated by BrandSuite (text, design, code, blueprints) are your property within the limits of applicable law, subject to payment due. The Provider retains ownership of the software, interface, prompt templates, BrandSuite brand-system tokens and all platform code. Reverse engineering, automated scraping or service replication are not permitted.

9. Acceptable use

You may not use BrandSuite to:

  • Perform illegal, fraudulent activities or violate third-party rights
  • Generate discriminatory, violent, sexually explicit, disinformation or hate-inciting content
  • Attempt to bypass technical limits, rate limiting or authentication systems
  • Automated scraping, crawling or service replication
  • Reverse engineer prompts, tokens or software components
  • Unauthorized resale of services to third parties

10. Service availability

The service is in a pre-launch phase and is provided as available. Unless a separate written agreement states otherwise, no minimum availability, recovery time or maintenance-notice period is guaranteed. We may temporarily change, suspend or interrupt features for maintenance, security or product evolution, subject to applicable law.

11. Limitation of liability

To the extent permitted by applicable law, the Provider is not liable for indirect damages, loss of profits, data loss or business interruption arising from use or inability to use the Platform. The Provider's total liability is limited to the amount actually paid by the user in the 12 months preceding the event. Liability for willful misconduct, gross negligence or violation of non-waivable consumer rights is not limited.

12. Changes to Terms

The Provider may update these Terms. Material changes will be communicated by reasonable means and with any notice required by law, stating their effective date. If you do not accept a change, you may stop using the service and, where applicable, exercise withdrawal or termination rights available under law or the purchased terms.

13. Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute falls under the exclusive jurisdiction of the Court of Florence, without prejudice to the consumer's non-waivable right to file suit before the court of their place of residence. For EU consumers the right to file a complaint via the European Commission's ODR platform (ec.europa.eu/consumers/odr) remains available.
